Jake Peavy...can he regain his 2007 form?

I am in a NL-only league with 7 teams keeping 8 players each prior to our draft. I am almost certain Peavy will be left unprotected and will make to me at the 7th position. Now my question is, is he worth taking at my 1st or 2nd pick? Are his injuries no longer a concern? If he gets dealt, his ERA away from Petco is 3.69 so that's not great. As long as he pitches for the Padres his wins will be scarce too.

Am I better off going with a younger pitcher with upside and less risk like Billingsley or Gallardo?

He's a good pick that late, but I have no idea what the rest of your keepers are so I'm flying blind a little.
